How to Prepare for Your Upcoming Immigration Court Hearing

A hearing for an individual in Immigration court is essentially a trial — an opportunity for one’s application to be heard on merits. You’ll have to get acquainted with the Immigration Court Practice Manual. Know when and what you’re able to submit and consult an immigration attorney near Houston, when you have any pressing concerns.

When the judge did not define a time where you must submit documents during your Master hearing, then you’ll utilize the deadlines designated in the Manual. When you aren’t sure what the time is, it is best to call the judge’s clerk to ask and verify the time of your “call up” date.

The Manual currently places the following filing deadlines:

(A) Non-detained aliens
For calendar hearings with individuals involved with non-detained alien charges, filings should be sent in at least 15 days before your hearing. This provision doesn’t apply to witnesses or exhibits extended solely for rebuttal and/or impeachment reasons. 

Replies to filings that got sent in advance of an individual’s calendar court date need to be filed within 10 days of your original Immigration Court filing. Objections to evidence can be completed at any point, including during your court hearing.

(B) Detained aliens
For individual calendar court hearings that concern detained aliens, the deadlines for filing are as designated by the Immigration Court.

Note — the court usually does not mind when submissions “get stuck” in the mail. This just means that the documents are best if delivered within the period listed above.
